FuelWise Terms of Use

Effective date: 2026-08-15

1. Agreement

These terms are between you and Andrew Hunt (“we”, “us”), and they cover your use of the FuelWise iOS application. Installing or using FuelWise means you accept them. If you do not accept them, do not use the app.

They sit alongside Apple's licence, they do not replace it. FuelWise is licensed to you under Apple's Standard End User Licence Agreement, which is what governs the licence itself. Everything here is in addition to that — the parts Apple's generic agreement has nothing to say about, and which matter for an app that estimates the nutrition in your food. Where the two genuinely conflict on the licence, Apple's wins.

These terms are not an agreement with Apple. Apple is not responsible for FuelWise or its contents — see section 13.

2. What you may and may not do

Your licence to use FuelWise comes from Apple's Standard EULA, on Apple-branded devices you own or control, and subject to the Usage Rules in Apple's Media Services Terms and Conditions. This section adds only what that does not already cover.

Do not: sell, rent, sublicense or redistribute the app; reverse engineer, decompile or disassemble it except where that restriction is prohibited by law; remove or alter any proprietary notices; or use it to build a competing service.

We keep all rights not expressly granted. FuelWise, its name, its design and its code remain ours. Your food log, your notes, your photos and your goals remain yours — we claim no ownership of anything you enter.

3. Subscription, trial, and billing

FuelWise requires an auto-renewing subscription. There is no free tier.

If your subscription lapses

You do not lose your data, and you are never locked out of your own history. If a subscription ends or lapses, FuelWise keeps working in a read-only mode: your entire log, your charts, your Apple Health sync and a full export of everything remain available. What stops is adding new entries, barcode lookup, and AI estimation.

This is a deliberate promise, not a current implementation detail. Months of logged meals are yours, and holding them hostage to a lapsed payment would be indefensible.

4. Estimates are estimates

This is the most important thing in this document.

FuelWise produces estimates of the nutritional content of food. Photo and description-based estimates are generated by an AI model that infers foods and portion sizes from limited information. They can be wrong, and sometimes substantially wrong — particularly about portion size, cooking fat, oils, sauces and dressings, which are frequently invisible in a photograph.

Every estimate states the assumption it made and a confidence value. Those are shown because they matter. Read them.

Barcode results come from the USDA FoodData Central database, which is compiled from manufacturer-submitted data and can be out of date or wrong relative to the package in your hand. Nutrition-label scanning reads printed text optically and can misread it.

Check anything that matters against the package, and correct it. Corrections are saved and take precedence afterwards. Do not rely on FuelWise for a number that must be exact.

5. Not medical advice

FuelWise is a general-purpose food and nutrition tracking tool for awareness. It is not a medical device, and nothing in it is medical, clinical, or dietary advice.

Do not use it to diagnose, treat, cure or prevent any disease or condition. Do not use it to calculate a medication dose. If you have a medical condition affected by what you eat — diabetes, kidney disease, an eating disorder, a food allergy, coeliac disease, phenylketonuria, or anything else — talk to a qualified professional, and treat any number in this app as unverified.

If you are managing a condition where a nutrient value could affect your health or your medication, do not rely on this app for that value.

Targets FuelWise suggests, including protein targets derived from body weight, are general rules of thumb. They are not personalised to you and are not a prescription.

6. Acceptable use

Use FuelWise to track your own food. Do not: use it unlawfully; attempt to circumvent the subscription, the authentication, or the usage limits; extract credentials from the app; make automated or bulk requests to our servers; interfere with the service or its infrastructure; or submit content that is unlawful or that infringes someone's rights.

The meal description field exists to describe food. Do not put sensitive information about yourself or anyone else in it — section 3.1 of the Privacy Policy explains where that text goes.

7. Availability

AI estimation and barcode lookup depend on servers we run and on third parties — OpenAI, USDA FoodData Central, Cloudflare, Apple — that we do not control. Those features may be unavailable, slow, or limited at times.

Manual entry, on-device nutrition-label scanning, your saved products and your entire existing log work without a connection, and are designed to keep working when the rest does not.

We may impose reasonable usage limits to keep the service affordable to run. They are set well above ordinary personal use.

8. Changes to the app and these terms

We may change, add or remove features. We may update these terms; if a change materially affects your rights, we will give notice in the app before it takes effect. Continuing to use FuelWise after that means you accept the revised terms. If you do not accept them, cancel your subscription and stop using the app.

We may discontinue FuelWise. If we do, we will give reasonable notice, stop charging subscribers, and make sure export continues to work so you can take your data with you.

9. Termination

You may stop using FuelWise at any time by deleting it and cancelling your subscription.

We may suspend or terminate your access if you materially breach these terms — in practice, if you attack or abuse the service. If we terminate access for a reason that is not your breach, you get a pro-rata refund for the unused period, which we will arrange with Apple.

10. Disclaimer of warranties

To the fullest extent permitted by law, FuelWise is provided “as is” and “as available”, without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the app will be uninterrupted or error-free, that defects will be corrected, or that any nutritional value it reports is accurate.

Some jurisdictions do not allow the exclusion of implied warranties, so some of this may not apply to you. Nothing here removes rights you have under consumer law that cannot be waived — including, for consumers in the UK, EU and Australia, statutory guarantees that apply regardless of what this document says.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or business interruption, arising out of your use of FuelWise, on any theory of liability, even if we were advised such damages were possible.

Our total liability for any claim relating to FuelWise is limited to the amount you paid us — in practice, through Apple — in the twelve months before the event giving rise to the claim.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

12. Governing law

These terms are governed by the laws of the State of Utah, United States of America, without regard to its conflict of law rules. The state and federal courts located in Utah County, Utah have exclusive jurisdiction over any dispute arising from them.

This does not take away rights you have where you live. If you are a consumer resident in another state or country, you keep the protection of the mandatory consumer laws of your place of residence, and you may bring proceedings there.

13. Apple

You and we acknowledge:

  1. These terms are between you and us only, not with Apple.
  2. We, not Apple, are solely responsible for FuelWise and its content.
  3. Apple has no obligation to provide maintenance or support for FuelWise.
  4. If FuelWise fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to FuelWise.
  5. Apple is not responsible for addressing any claim by you or a third party relating to FuelWise, including product liability, failure to conform to legal or regulatory requirements, and claims under consumer protection or similar legislation.
  6. If a third party claims FuelWise infringes their intellectual property, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
  7. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  8. Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, have the right to enforce them against you.

14. General

If any provision is held unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. These terms, with the Privacy Policy, are the entire agreement between us about FuelWise. You may not assign them; we may assign them to a successor.
